New Trend Making Foreclosures Easier To Defend

There is a new trend taking place in courtrooms and judicial chambers around the country.  More and more judicial districts are requiring that mediation take place before any judgment of foreclosure will be entered.  However, the catch is that the judge will only order mediation in cases where the foreclosure becomes contested.  But what exactly makes a foreclosure contested?

Plenty Of Blame To Go Around

Whose fault is it?  There is a lot of blame to go around.  After all, there is no one person or entity that could cause such an economic crisis, no matter how hard they might try.  As the attorney hired by the banks to execute the foreclosures, I have had the opportunity to interact with all of the possible culprits.

 

Is it the bank’s fault?  Well, there are two banks to speak of in most foreclosure situations; there is the bank that did the lending and the bank that purchased the Note and Mortgage and is now initiating the foreclosure.  The bank that purchased the Note and Mortgage as an investment is a victim.  They do not want to foreclose.  They thought that they would be collecting mortgage payments and that the loan was a good loan.  They clearly thought wrong.

 

Is it the lending bank’s fault?  The bank that originally lent the money did so because the borrower met certain qualifications.  The bank reviewed the loan application that was filled out by the borrower or the mortgage broker and lent the money based on that application, however they failed to verify any of that information by requesting proof of employment history, credit scores, or income statements.  They thought the loan applications were filled out honestly.  They clearly thought wrong.

 

Is it the borrower’s fault?  The borrower was looking at a real estate market that was skyrocketing.  They figured that they could purchase a house now and sell it later for way more than they paid because real estate is the safest investment and the real estate market would continue to rise.  They thought that any loan they would receive today would easily be paid bank with the equity they could pull from their ever-increasing value of their house.  They clearly thought wrong.      

 

Who is to blame for the mortgage foreclosure crisis?  Everyone.  We all thought we were making correct decisions and we were all wrong.  No one stopped to take the time to educate themselves before taking these unnecessary risks.  The true cause of the massive amount of foreclosures facing the nation today is ignorance.  Suffice it to say, our best weapon against foreclosure is education.  Educate yourself at www.ForeclosureDefenseSecrets.com.

Some Things To Consider

What Stage Are You In?

How you attack the bank’s case and how you defend yourself from foreclosure depends mainly on what stage of the foreclosure you are facing.  Cleary, the earlier you take action the better off you are because you have more options to take advantage of.  However, there are appropiate measures of defense for each stage of the foreclosure action. 

If you have just missed your first mortgage payment, or you expect to miss one soon, you have the advantage of being able to work the deed recording system and avoid the damage to your credit and risk of deficiency judgment by preventing a foreclosure judgment from being entered against you.  If you have already been served with a foreclosure complaint but have not yet been defaulted, you have the opportunity to stall the foreclosure action with various motions and other court filings.  Even if a foreclosure judgment has already been entered against you, you have the option of having that judgment vacated and stoping the sale of your property.

Tis The Season

With Christmas upon us, many banks have been feeling the giving spirit and putting files on hold as to protect themselves from damaging publicity and to buy some more time to complete loss mitigation at a time when they are short handed due to a mass number of employees taking holiday vacations.  This time has quickly come to an end.

If you have missed a mortgage payment and are thinking that the banks have forgotten about you or that they are willing to put the file on hold for as long as it takes to complete loss mitigation, you are sorely mistaken.  Come February, all of these files will be coming off of hold and the banks will soon be giving my firm the orders to speed up the process and complete the foreclosure as quickly as possible.

Experts in the field have already predicted more foreclosures in the first half of 2009 than we saw in the first half of 2008.  We are not at the beginning of the end of the mortgage crisis, we are merely at the end of the beginning.  There are plenty more foreclosures to come, and you or someone you know will surely be affected by this foreclosure epidemic.

If You Think You Are Safe, You Are Wrong

The most common victim of foreclosure is the borrower who bought more house than they could ever afford, be it in order to flip the house for profit or to live in a dream house that should have remained a dream. However, a large number of people facing foreclosure are people who bought the house they should have purchased. These people had good jobs and good credit and entered into a mortgage that was fair and affordable.

These borrowers were making their mortgage payments until one catastrophe or another occurred in their life. For some, it was illness or family fatality. For most, it was the loss of income due to downsizing or the outright closing of the company they worked for. For these people, mortgage foreclosure was never a concern because these people were not in over their heads. If you think you are safe, you are wrong. The Time of Year To Give Thanks

As families across the country gather around their dining room tables this Thanksgiving to feast on turkey and watch football, the conversation around the table will most likely lean towards the economic crisis facing us all today. I would urge you, however, to remind your family and friends of all the things to be thankful for.

For instance, those who are finding it difficult to make their mortgage payments in these trying times should be thankful that there are ways to delay the foreclosure process almost indefinitely. Be thankful for the loss mitigation offered by nearly every lender right now and the willingness of banks to not only lower the interest rates of your current mortgage but also the principal amount.

Be thankful for loan modification agreements, refinancing, short sales, and reinstatement. Be thankful for Motions To Dismiss, Requests To Produce, and other pleadings that you can file with the court in order to stop the bank from foreclosing. Be thankful for the ability to defend yourself from foreclosure while avoiding the cost and ineffectiveness of programs that promise to save your house for you but end up leaving you homeless and broke.

Be thankful for knowledge because knowledge truly is power. North Miami Mayor Proposes Foreclosure Moratorium

Miami-Dade County is dubbed the foreclosure capital of the state of Florida, and now the county could be taking on the most drastic housing relief effort to date.

If Miami-Dade’s chief judge approves this moratorium, it could stop all foreclosures for four months, starting as soon as November 1st. It’s a measure that could eventually be adopted in all counties across the state.

Roughly 36 families are evicted everyday, and a local mayor is proposing to put a stop to it.

“I think it will be immediate relief that could happen within weeks for the residents of our county,” said North Miami Mayor Kevin Burns.

Burns wants a countywide moratorium on foreclosures, oddly enough one that even the banks could support. The program is mirrored of what Philadelphia started this summer that has remarkably saved 80% of their homes in foreclosure.

“If they can do it in Philadelphia, the City of Brotherly Love, I think they can do it the City of North Miami but also in Miami-Dade County,” said Burns. “And I assure you that if the Chief Judge approves it here in Miami-Dade County, they’ll do it throughout the state of Florida.”

The plan is pretty simple: There would be a 120 day halt to all existing foreclosure filings, and new filings would be sent to mediators within 45 days of the filing. Essentially banks and homeowners would be forced to meet to work something out.

Additionally the moratorium would give homeowners and banks time to take advantage of new assistance programs approved by Congress but haven’t been rolled out.

With the backing of the North Miami Council Tuesday night, the plan is now headed to the chief judge of the circuit court. His decision could not only keep South Florida families in their homes, but perhaps keeps the rest of the state’s homeowners as homeowners.

Palm Beach and Seminole Counties each have similar administrative orders that provide mediation to those homeowners that request it.
